NOTIFICATION OF PLANNED SOLE SOURCE AWARD No. 24LTS001
NSPA intends to award a contract on a sole source basis to the company:
Airbus Defence and Space S.A.

for the provision of:
Up to three (3) new Airbus A330 (CEO) Multi-Role Tanker Transport (MRTT) aircraft in NATO’s Multinational MRTT Fleet (MMF) configuration
NSPA believes this requirement can only be fulfilled on a sole source basis due to:
NSPA has procured ten (10) Airbus A330 MRTT for the NATO owned MMF, participated by member nations Belgium, Czech Republic, Germany, Luxembourg, Netherlands and Norway. These aircraft were initially procured on a sole source basis as the Airbus A330 MRTT was the only solution meeting the key capability requirements. As fleet commonality is mandated by the MMF Nations and is essential to provide an efficient and effective service these additional aircraft will also be procured on a sole source basis.
If you believe your firm is capable of fulfilling this requirement, you are invited to submit evidence of your demonstrated capability (proof of prior performance, etc.) to Senior Procurement Officer (SPO) juan-ramon.aviles-alcaraz@nspa.nato.int and source-file@nspa.nato.int, not later than 10 calendar days after the date of publication of this notification of planned sole source award. Evidence of demonstrated capability received after this date will not be considered.
NSPA will assess the evidence provided and will advise the firm of its determination, including rationale if not supported, after requesting further clarification if necessary. If the firm believes the determination is not justified and therefore unduly restricts competition, a formal complaint may be submitted to the SPO identified in determination notification with a copy to the NSPA Competition Advocate at competition.advocate@nspa.nato.int. This complaint must provide detailed justification to support the claim for unduly restricting competition.
If the Senior Procurement Officer is unable to resolve the complaint satisfactorily, the firm shall be so informed and the complaint shall be forwarded thereafter to the Competition Advocate for resolution.
The Competition Advocate will convene an independent Complaints Committee to evaluate the complaint and will endeavour to advise the complainant of the outcome, within fifteen (15) working days after the Committee has met. The decision of the Complaints Committee in such cases shall be final.
